Hong Kong courts are set to deliver long-awaited verdicts in the national security trial of pro-democracy media tycoon Jimmy Lai on 15 December 2025, marking one of the most closely watched legal decisions since Hong Kong’s return to Chinese rule in 1997.

Jimmy Lai, the 78-year-old founder of Apple Daily, faces charges of:

  • Conspiracy to collude with foreign forces under Hong Kong’s National Security Law (NSL), carrying a possible life sentence
  • Conspiracy to publish seditious publications under a colonial-era sedition law

Lai has pleaded not guilty to all charges.

The case has drawn significant international attention, with the US president reportedly raising Lai’s detention with China’s leadership, and British Prime Minister Keir Starmer facing pressure to intervene on behalf of Lai, who is a British citizen.

The prosecution alleges that Lai masterminded a broad conspiracy through Apple Daily’s publications, opinion pieces, and talk shows, claiming they incited disaffection against the government and encouraged foreign sanctions against Hong Kong and China. Prosecutors also cited Lai’s political contacts in the US, UK, and Taiwan, and alleged links to protest groups.

Lai denies seeking foreign policy influence or supporting violence or separatism, stating that Apple Daily represented core Hong Kong values such as rule of law, freedom of speech, freedom of religion, and democracy.

While the article is factual and balanced in tone, it also underscores deeper structural and legal tensions surrounding the Jimmy Lai case.

First, the breadth of conduct criminalised is striking. Much of the prosecution’s case appears to rely on editorial content, opinion pieces, and political advocacy, activities traditionally protected in common-law systems. The reliance on both the National Security Law and a colonial-era sedition statute creates a legal framework so expansive that it risks blurring the line between genuine national security threats and political expression or dissent.

Second, the emphasis on Lai’s international contacts raises concerns about guilt by association. Engagement with foreign politicians, diplomats, or media figures—particularly for an international media proprietor—is not inherently unlawful. Framing such interactions as evidence of conspiracy risks retroactively criminalising political networking, rather than proving concrete intent to endanger state security.

Third, the handling of detention conditions and health issues remains troubling. While authorities maintain that Lai’s medical needs are met and that solitary confinement was voluntary, the prolonged pre-verdict incarceration of an elderly, diabetic defendant—combined with disputed health deterioration—raises legitimate questions about proportionality and humane treatment, regardless of the eventual verdict.

Finally, the article highlights how the case has become a symbolic flashpoint between Hong Kong, Beijing, and Western governments. This internationalisation may complicate perceptions of judicial independence, even if the courts seek to maintain procedural legitimacy.
